over discriminatie van kastelozen (Dalits) (20 september 2005)

Vraag 1
Heeft u kennisgenomen van het rapport "The Missing Piece of the Puzzle: Caste discrimination and the Conflict in Nepal" van het Center for Human Rights and Global Justice (CHRGJ)?
Antwoord
De Commissie heeft inderdaad het door het geachte Parlementslid genoemde rapport met grote aandacht gelezen en is verheugd daarin een positieve beoordeling aan te treffen van de sterke reputatie die de EU in Nepal heeft opgebouwd door de regering ertoe te dwingen degelijk onderzoek te verrichten naar en oplossingen te vinden voor sommige vrij ernstige inbreuken op de mensenrechten in dat land1.

Vraag 2
Deelt u visie uit het rapport dat kastendiscriminatie een belangrijke oorzaak is van het conflict in Nepal, maar dat juist 'kastelozen' (Dalits), in het bijzonder vrouwen, hiervan het slachtoffer zijn?
Antwoord
Kastendiscriminatie in Nepal en de daaruit voortvloeiende sociale en politieke belemmeringen waarmee meer dan twintig procent van de bevolking van dat land te kampen heeft, heeft de sociale spanning doen toenemen. De Commissie is het ermee eens dat vooral vrouwen het slachtoffer van het conflict zijn.

Vraag 3
Wat doet de Delegatie van de Europese Commissie voor Nepal en India om kastendiscriminatie als mensenrechtenissue aan de orde te stellen bij respectievelijk de Nepalese en de Indiase regering?
Antwoord
De Commissie heeft bij de Nepalese regering constant aangedrongen op een dringende aanpak van de verslechterende situatie van de mensenrechten in dat land. Voorts heeft zij de regering herhaaldelijk eraan herinnerd dat haar ontwikkelingsprojecten tot doel hebben de regionaal, sociaal en economisch benadeelde groepen bij te staan en zo de belangrijkste grondoorzaken van het conflict aan te pakken.

Vraag 4
Welke prioriteit heeft de bestrijding kastendiscriminatie in projecten en programma's van de Europese Commissie, de Asian Development Bank, de Wereldbank, UNICEF, UNDP en andere VN-organisaties?
Antwoord
De Commissie kan niet spreken in naam van de internationale financieringsinstellingen of van de organisaties van de Verenigde Naties (VN). Wat de Commissie betreft zijn sinds 1995 in alle communautaire samenwerkingsovereenkomsten bepalingen inzake mensenrechten opgenomen, die de basis vormen voor een positieve dialoog over de zorgpunten inzake mensenrechten. Bij de communautaire projecten en programma’s in Nepal and India wordt er nauwlettend op toegezien dat de eindbegunstigden worden bereikt, die meestal tot de armste geledingen van de maatschappij behoren.

Vraag 5
Wat gaat de Europese Commissie doen met de aanbevelingen uit de zogenaamde Kathmandu Dalit Declaration, die tijdens de brede 'International Consultation on Caste-based Discrimination' eind 2005 is aangenomen?
Antwoord
De lidstaten en de Commissie hebben hun krachtige steun uitgesproken voor de goedkeuring door de VN-Commissie voor mensenrechten, tijdens haar laatste vergadering, van een ontwerpresolutie van de Subcommissie voor bevordering en bescherming van mensenrechten. In die resolutie werden een algemene studie over kastendiscriminatie en de opstelling van ontwerpbeginselen en –richtsnoeren voor de afschaffing daarvan aangekondigd.
De Commissie zal bij het opstellen van de projecten en programma’s en bij het toezicht daarop en de evaluatie daarvan de nodige aandacht blijven besteden aan de aanbevelingen van de “Kathmandu Dalit Declaration”.

Vraag 6
Kunt u een overzicht geven van (mede) door de Europese Unie gesteunde initiatieven en programma's die de bestrijding van discriminatie van kastelozen hoge prioriteit geven?
Antwoord
De Commissie heeft kastendiscriminatie en de minderheidsstatus in India aangemerkt als de centrale thema’s van de projecten in het kader van het Europees initiatief voor democratie en mensenrechten (EIDHR).
In Nepal draagt de Commissie door tal van instrumenten, waaronder het Europees initiatief voor democratie en mensenrechten, het snelle-reactiemechanisme en het bilaterale programma van de EG, jaarlijks voor ongeveer 1 miljoen euro bij tot de ondersteuning van het maatschappelijke middenveld en de officiële instanties in Nepal, met de bedoeling de democratie en de mensenrechten te bevorderen. In 2004 en 2005 heeft de Commissie de oprichting gesteund van regionale kantoren van de nationale Commissie voor de mensenrechten in elk van de vijf ontwikkelingsdistricten in Nepal (450 000 euro aan EG-subsidies), terwijl de steun voor de “Nepal Bar Association” (400 000 euro aan EG-subsidies) bedoeld was om de kostenloze rechtsbijstand, de mensenrechtensituatie en de rechtstoegang te verbeteren. Voorts is via steun aan niet-gouvernementele organisaties (NGO’s) een breed scala aan activiteiten gefinancierd, waaronder opleiding op het gebied van de mensenrechten, de bestrijding van kastendiscriminatie door de bevordering van het recht op onderwijs, het aankaarten in de media van mensenrechtenkwesties, de opleiding van journalisten en het bijbrengen van vaardigheden aan vrouwengroepen. Ten slotte maakt de Commissie alles in gereedheid om een groot bedrag aan vastleggingskredieten (5 miljoen euro) op te nemen om het controlebezoek van het VN-bureau van de Hoge Commissaris voor de mensenrechten (OHCHR) aan Nepal te ondersteunen. Deze bijdrage maakt ongeveer 30 procent van het hele OHCHR-budget uit.
In India probeert de Commissie de kansarme gemeenschappen zoals de Dalits en de Adivasis te bereiken door het gros van de communautaire ontwikkelingshulp te besteden aan sociale ontwikkelingsprogramma’s op het gebied van gezondheid en onderwijs. Van met name de subsidie van 200 miljoen euro voor de veralgemening van het basisonderwijs worden goede resultaten verwacht voor de kinderen in de Dalit-gemeenschappen, aangezien onderwijs voor allen deze kinderen uiteindelijk betere kansen zal bieden om posities op alle niveaus van de Indische gemeenschap in te nemen.

Vraag 7
Welke concrete maatregelen neemt u om ervoor te zorgen dat de Millenniumdoelen, in het bijzonder het doel "halvering van armoede" en ‘alle kinderen naar school’, óók bij kastelozen worden gerealiseerd in (mede) door de Europese Commissie gefinancierde programma's?
Antwoord
Door de communautaire toezicht- en evaluatieregelingen wordt nauwlettend nagegaan of de eindbegunstigden (meestal de armste en meest kansarme gemeenschappen zoals de Dalits en de tribalen) worden bereikt.

Vraag 8
In het Joint Action Plan van het EU-India strategisch partnerschap, staat dat er gezamenlijke consultaties en discussies over mensenrechten en democratie gehouden zullen worden. Bent u voornemens in deze discussies ook de discriminatie van kastelozen aan de orde te stellen?
Antwoord
De kwestie van de kastendiscriminatie wordt, zoals de overige zorgpunten op het gebied van de mensenrechten, behandeld in het kader van het periodieke overleg tussen de EU en India over mensenrechten. De volgende vergadering vindt in december 2005 in Delhi plaats.

Question 1
Has the Commission read the report entitled "The Missing Piece of the Puzzle: Caste discrimination and the Conflict in Nepal", published by the Centre for Human Rights and Global Justice (CHRGJ)?
Answer
The Commission has indeed read the report mentioned by the Honourable Member with great interest and is pleased to note the report’s positive assessment on the EU’s strong record in Nepal in compelling the government to adequately investigate and deal with some of its more severe human rights violations1.

Question 2
Does the Commission share the view expressed in that report that caste discrimination is a significant cause of the conflict in Nepal and that, specifically, untouchables (Dalits), especially women, are the victims thereof?
Answer
Caste discrimination in Nepal and the ensuing social and political impediments faced by more than twenty per cent of the country’s population has increased social tension. The Commission agrees that women have been particularly victimised by the conflict.

Question 3
What is the Commission Delegation to Nepal and India doing in order to bring the issue of caste discrimination to the attention of the Nepalese and Indian Governments respectively?
Answer
The Commission has consistently appealed to the Nepalese Government for an urgent need to address the deteriorating human rights situation in the country. Moreover, the Commission has repeatedly reminded the Government that the purpose of its development projects is to assist regionally, socially and economically disadvantaged groups of people and thus to address major root causes of the conflict.

Question 4
What priority does the campaign against caste discrimination have in projects and programmes initiated by the European Commission, the Asian Development Bank, the World Bank, UNICEF, UNDP and other UN organisations?
Answer
The Commission cannot speak for the International Financing Institutions or for the United Nations (UN) organisations. As far as the Commission is concerned, human rights clauses are included in all EC co-operation agreements since 1995 and form the basis for a positive dialogue on human rights concerns. As regards EC projects and programmes in Nepal and India, particular attention is given that these programmes reach the target beneficiaries, who usually belong to the poorest sections of society.

Question 5
What will the European Commission do with regard to the recommendations set out in what is known as the Kathmandu Dalit Declaration which was adopted at the broadly-based International Consultation on Caste-based Discrimination in late 2004?
Answer
Member States and the Commission strongly supported the adoption by the UN Commission on Human Rights (CHR), during its last session, of a draft resolution by the Sub-Commission on the Promotion and Protection of Human Rights to undertake a comprehensive study on caste-based discrimination and to develop draft principles and guidelines for its elimination.
The Commission will continue to give the recommendations of the Kathmandu Dalit Declaration due attention in the design of projects and programmes, as well as in their monitoring and evaluation.

Question 6
Can the Commission give an overview of initiatives (partly) supported by the European Union and programmes which ascribe high priority to the campaign to end discrimination against untouchables?
Answer
The Commission has identified caste-based discrimination and minority status within India as a focus for projects under the European Initiative for Democracy and Human Rights (EIDHR).
In Nepal, through a variety of instruments, including the European Initiative for Democracy and Human Rights, the Rapid Reaction Mechanism and the EC bilateral programme, the Commission contributes about € 1 million a year to both civil society and statutory bodies in Nepal aimed at promoting democracy and human rights. During 2004 and 2005, the Commission has supported the establishment of regional offices of the National Human Rights Commission in each of the five development districts of Nepal (EC grants € 450,000) while support to the Nepal Bar Association (EC grants of € 400,000) has focused on improving free legal aid, human rights and access to justice. Moreover, support to non-governmental organisations (NGOs) has funded a wide range of activities from human rights education, combatting caste based discrimination through the promotion of the right to education, media advocacy on human rights issues, journalism training and skill development training for women’s groups. Finally, the Commission is preparing a major commitment (€ 5 million) for support to the UN Office of the High Commissioner for Human Rights (OHCHR) mission to Nepal. This contribution represents some 30 per cent of the total OHCHR budget.
In India, the Commission attempts to target disenfranchised communities such as Dalits and Adivasis by focusing the bulk of EC development assistance towards social development sector programmes in health and education. In particular, the € 200 million grant for the universalisation of elementary education is expected to yield important results for children from Dalit communities, since Education for All will ultimately provide a better chance to these children in gaining positions at all levels of Indian society.

Question 7
What specific measures is the Commission taking with a view to ensuring that the Millennium Goals, especially ‘eradicating extreme poverty’ and ‘achieving universal primary education’ are attained in the case of untouchables in programmes which it (partly) finances?
Answer
Through EC monitoring and evaluation mechanisms, particular attention is given to assessing whether the target beneficiaries (which generally consist of the poorest and most disenfranchised communities such as Dalits and tribals) have been reached.

Question 8
The Joint Action Plan under the EU-India Strategic Partnership provides for joint consultation and discussions about human rights and democracy. Is the Commission intending to include discrimination against untouchables in those discussions?
Answer
This issue of caste discrimination, as well as other human rights concerns, is addressed within the framework of regular EU-India consultations on human rights, the next session of which will take place in December 2005 in Delhi.
